Terms & Conditions
The standard subscription period for all PAT products, including airline Participation and data content, is from 1st January to 31st December of each year. New subscriptions commenced during this period will be charged proportionally for the first year.
All subscriptions are automatically renewed unless notification to change is received by 1st November of the preceding year. PAT does not offer refunds, although credit may be available towards a new subscription. PAT offers the flexibility to upgrade at
any time during the subscription period, also to change the delivery address.
Full payment is required within 30 days of the invoice unless there is agreement to pay through the IATA clearing House. Books will be delivered after full payment is received. Late payment may result in extra handling costs
Airline customers are normally billed quarterly via IATA Clearing House unless alternative arrangements are made.
Tax on subscriptions
VAT (in accordance with the applicable European standard) will be charged to all subscribers in the Netherlands. Subscribers elsewhere in the European Union will not be charged VAT, provided IATA Netherlands Data Publications is advised in advance
of the VAT Identification Number applicable to the delivery address.
Copyright and Trademarks
No part of the PAT publications may be reproduced without prior written permission. PAT data supply is for use in the customer's own computer systems and for own use only, unless prior written permission has been granted.
The IATA, SITA and PAT names, logos and product and service names are trademarks or registered trademarks owned by IATA and SITA, and protected by law. All right reserved
Errors, omissions or misprints
Although IATA and SITA make every reasonable effort to ensure that the information published in PAT and on this website is as complete and accurate as possible, they shall not be responsible for any errors, omissions or misprints.
General Rules Online (GRO) additional terms & conditions
Definitions and Applicability:
In these general terms and conditions ("General Terms & Conditions") the following
terms shall have the following meanings:
- "IATA": International Air Transport Association (Netherlands) B.V., trading under the name of IATA Netherlands Data Publications;
- "Information": all data, information, materials, documents, files, etc. in so far as published on the PAT General Rules Online (GRO) site by or with the permission of IATA;
- "PAT General Rules Online (GRO) site": the collection of Internet web pages that may be accessed through the domain name www.pat.aero using the relevant user id and personal password;
- "Subscriber": any legal entity or natural person acting for purposes which are within his or her trade, business or profession, with a Subscription;
- "Subscription": agreement between Subscriber and IATA by which IATA grants Subscriber the non-exclusive and non-transferable right, which right is accepted by Subscriber, to access the PAT General Rules Online (GRO) site and the Information
during the relevant subscription period in return for payment by Subscriber to IATA of a subscription fee;
- "Subscription period": January 1 up to and including December 31 of the same year;
- "User(s)": the natural person(s) who is (are) designated by Subscriber and authorized by IATA through a user id and personal password to access the PAT General Rules Online (GRO) site. The Subscriber itself shall not receive a user id and
personal password, only User(s) shall receive such user id and personal password;
The General Terms & Conditions shall apply to each Subscription. IATA explicitly rejects the applicability of any general terms and conditions of Subscriber to a Subscription.
Scope of Subscription:
IATA grants Subscriber to the PAT General Rules Online (GRO) site the non-exclusive and non-transferable right, which right is accepted by Subscriber, to access the PAT General Rules Online (GRO) site and the Information during the relevant subscription
Ownership, intellectual property rights and confidentiality:
The PAT General Rules Online (GRO) site and the Information are owned by or supplied to IATA. The Information is protected by industrial and intellectual property rights (for instance, but not restricted to, copyrights) of IATA, its affiliates, third
party suppliers or partners, as the case may be. Subscriber shall not be allowed to use in any way whatsoever any image, trade name, trademark, service mark or logo displayed on the PAT General Rules Online (GRO) site without the prior written permission
of IATA, its affiliates, third party suppliers or partners, as the case may be.
Subscriber agrees to take all steps necessary to protect IATA, its affiliates, third party suppliers or partners’ proprietary rights to the Information and agrees not to trade, copy, print, save, edit, publish or in any other way infringe
upon such proprietary rights.
Subscriber shall not in any way whatsoever reproduce, transmit, store in a retrieval system, disclose or permit the disclosure of (any part of) the Information to any third party without the prior written permission of IATA.
Subscriber shall ensure that any of its User(s), directors, officers or employees shall comply with the provisions regarding ownership, intellectual property rights and confidentiality. The User(s), director’s, officer’s
and employee’s confidentiality obligations shall also extend beyond the period of their employment with or by Subscriber.
Subscriber will make no use of the Information following the termination of a Subscription. The obligations confidentiality shall survive the termination of a Subscription.
IATA shall have the right to inspect, or appoint an independent third party to inspect, at any time during normal business hours, Subscriber’s premises, offices or place of business in order to ascertain that Subscriber and User(s) are
fully complying with all the terms of this Subscription. The costs of such inspection shall be borne by IATA unless such inspection reveals that Subscriber has breached one or more of its obligations under this Subscription in which case they shall
be borne by Subscriber.
Without the prior written authorization of IATA Subscriber shall not establish any link, connection or gateway between the PAT General Rules Online (GRO) site and any other (Internet) website or computer network whatsoever.
Subscriber agrees that he/she shall use the Information acquired through the General Rules Online (GRO) site for its own, internal purposes and shall not give access to or transfer the Information to a third party without prior written authorization
The user id’s and personal passwords required to access the PAT General Rules Online (GRO) site as provided to Subscriber by IATA are unique. Subscriber is fully responsible for maintaining the confidentiality of such user id's and personal passwords
and is fully responsible for any use thereof. Subscriber shall immediately inform IATA of any unauthorized use of a user id or personal password or any other breach of security. Subscriber shall ensure that User(s) shall not, by any means, share
user id's or personal passwords with a third party.
Default and Termination:
Any default by the Subscriber under the Subscription or these General Terms & Conditions shall entitle IATA to terminate the Subscription with immediate effect, without prejudice to IATA’s right to recover the full subscription fee,
damages as well as the interest that has accumulated pursuant to the paragraph below.
If Subscriber for whatever reason has not paid the subscription fee due by the due date, IATA may levy interest on the outstanding amount at a rate of 1% (one percent) per (part of a) month from the due date until the date the subscription fee
is received by IATA.
Limitation of liability:
IATA, its affiliates, third party licensors and partners shall not be liable towards Subscriber or any third party either by contract or otherwise for any direct, indirect, incidental, special or consequential damages relating to or caused by
or arising out of Subscriber’s failure to comply with these General Terms & Conditions or Subscriber's use or inability to use the PAT General Rules Online (GRO) site or the Information, unless such damages are exclusively the result of willful misconduct
or gross negligence on the part of IATA.
Subscriber shall indemnify, safeguard and hold IATA harmless from and against all actions, claims or demands of third parties, including costs to be incurred by IATA in connection therewith, arising from or relating in any way to a Subscription.
IATA reserves the right to amend these Terms & Conditions unilaterally and without prior notice. IATA shall however notify each Subscriber of any amendment to these Terms & Conditions within 30 (thirty) days after such
amendment has been put into effect.
If a Subscriber does not agree with an amendment as mentioned in the paragraph above, such Subscriber shall have the right to terminate its Subscription within 30 (thirty) days after having received a notice from IATA as mentioned in the paragraph
above. Upon such termination, such Subscriber shall be entitled to a pro-rata refund of the subscription fee from IATA.
IATA and SITA respect your privacy and recognise the need to protect the personally identifiable information (any information by which you can be identified, such as name, address and telephone number) you share with us. We would like to assure you that we follow the appropriate standards when it comes to protecting your privacy on our websites.
In general you can visit our websites without telling us who you are or revealing any personal information about yourself. We track the internet address of the domains from which people visit us and analyse this data for trends and statistics, but the individual user remains anonymous.
Some of our web pages use "cookies" so that we can better serve you with customised information when you return to our site. You can set your browser to notify you when you are sent a cookie, giving you the option to decide whether or not to accept it.
IATA and SITA will not sell, trade or disclose to third parties any information derived from registration without the consent of the user or customer, except where required to do so by law.
